Prop 37 Passed: $25 Billion in Down Payment Help, But There's a Catch

by Sirrom Alizem

California just changed the down payment conversation for new-home buyers, and most people don't know the fine print yet.

CBS News projects Prop 37 approved, and KQED reports it won Tuesday night with 61% of the vote. Results are still unofficial and being counted.

What Is Prop 37?

Prop 37 authorizes the California Housing Finance Agency (CalHFA) to issue up to $25 billion in revenue bonds to fund a new program called the middle-class homeownership loan. According to the Legislative Analyst's Office, homeowners repay the loans, and those repayments cover the bonds. No direct cost to state or local taxpayers.

  • CalHFA can issue up to $25 billion in revenue bonds.
  • Each loan can cover up to 17% of the home price.
  • The buyer must still put down at least 3%.
  • CalHFA has to set the program up. No launch date exists yet.

Who Qualifies for Prop 37 Down Payment Help?

Here is the short list:

  • You must be a California resident for at least one year.
  • Your household income must be under 200% of the area median income, meaning no more than double the typical income in your area.
  • You must be the first purchaser of an eligible home.

The income test is tied to your area's median income, so the dollar limit depends on where you buy. Those local numbers have not been published yet.

Does Prop 37 Apply to Existing Homes?

No. This is the most important thing to understand before you get excited.

The middle-class homeownership loan applies only to newly constructed homes, or the first sale of a converted nonresidential property. Resale homes do not qualify. If you are buying a home that has been sold before, Prop 37 is not for you.

For context, the California Association of Realtors reported that California's median single-family price in Q3 was $894,630, with several Bay Area counties recording medians above $1 million. The home price must fall below a cap ranging from $1 million to $1.5 million depending on the county, adjusted annually. We do not yet know the exact cap for Santa Cruz, Santa Clara, or Monterey counties.

What Should Local Buyers and Sellers Watch Next?

The program is real, but it is not open yet. CalHFA still has to set it up, and there is no launch date. The LAO is honest that how much it helps depends on whether investors buy the bonds, how these loans compare with other down payment help, and whether it actually leads to more homes being built.

For local buyers, it is worth knowing that new construction is in the pipeline here. For example, 178 for-sale townhomes are planned at Village on the Green, the old Aptos Par 3 golf course at 2600 Mar Vista Drive. That project is still in Santa Cruz County pre-application review with no asking price listed, per Hoodline's October 2026 report. I am not saying those homes will qualify. What I am saying is that new construction is coming locally, and when this program launches, it could matter.

If you own a resale home, this is worth watching, not panicking about. Know what your home is worth and how it stacks up against new construction nearby.

One fair criticism: the League of Women Voters opposed it because nothing requires these homes to be near jobs, transit, schools or services (CBS News).
